今週は赴任当初の給与支払いついてです。
Q.
タイへの赴任が決まっており、来月にタイに入国する予定です。入国後にワークパーミットの申請をするのですが、それまでの間、給与の支払いは出来るのでしょうか。また、出来ない場合、事前に会社からお金を渡すなどの対応は出来るのでしょうか。
I will transfer to Thailand next month. Can the company pay salary before I will obtain Work Permit? If cannot, can the company provide advance money?

結論から、申しますと給与支払いはワークパーミット取得後でないと出来ません。
As a result, the company cannot pay salary for expats before obtaining work permit.
事前に会社からお金を渡したい場合は以下の2通りの方法があります。
There are two options in case the company need to provide money in advance.
- 赴任者への貸付にして給与支払い後に相殺する
1. The company lend money and expats pay off it after salary payment
2.赴任者への仮払いで処理し、ワークパーミット取得後に2カ月分などをまとめて給与(費用)処理し、仮払いを相殺する
2. The company provide advance money and expense for two months’ salary after obtaining salary payment, and off set with advance.
1.の場合は貸付となりますので、所得税の問題は出てきません。
2.の場合は2カ月分などをまとめて給与処理する際に、その分多く所得税を控除、納税する
ことになります。
For No.1, there is no issue about income tax, since payment is just a loan.
However, if the company select No.2, the company need to deduct and declare two month income tax when the company expense two months’ salary.
なお、ワークパーミット取得後でないと一般的には個人の銀行口座が開設出来ませんので併せてご留意ください。
For the matter relevant to that, expats couldn’t open personal bank account before obtaining Work Permit in general.
