Q マレーシアではローカル銀行での口座開設が不可能と聞きましたが、資本金を送るにあたっての何か別の手立てを講じることは可能ですか。
Q In Malaysia, now many foreign companies cannot open bank account. Is there any other way to send capital?
A マレーシアでは昨年の規制が強化された関係で、取締役名簿に記載されている取締役全員の署名が銀行の担当官の前で必要となります。仮に、その取締役に外国人が入っていた場合、EPの取得が義務付けられています。ただ、初めてこちらに出てこられる方で、EPを取得していることはありません。EPを取得するために開設をしなければならないのに、EP取得を要求される。そのため、かなり矛盾な状態が起こっております。これを解消する方法は二つです。一つは、邦銀（三菱東京、みずほ、三井住友）３行で開設を目指すか、もしくは、外資系の銀行で開設を試みるかです。邦銀の選択肢では、日本側担当官から連絡が行かない限り開設されません。そのため、日本側で取引がなければ、開設ができないことになります。ここで多くの方は断念をせざるをえません。ただ、もう一つの方法については、あまり吟味されておられない方が多く見受けられます。シンガポールにある銀行はEP なしで開設もできます。また、この銀行は、シンガポールでは結構な地位にありますので、財務的にも安心して良いでしょう。もし口座開設でお困りの方がいらっしゃいましたら、気兼ねなくお尋ねくださいませ。解決に向けたお手伝いをさせていただきます。
A Since last year, Bank Negara made the regulation more strict in Malaysia. As for this reason, many foreign companies cannot open corporate bank account in Malaysia. Now, bank needs every director’s signature from every director on the Form in officer’s presence. If there is any foreigner in Directors, bank requires EP. This mean if foreigner does not have EP, company cannot open corporate bank account. So, you have two choices to avoid no corporate bank account. One is “Opening bank account in 3 mega bank”, Mitsubishi-Tokyo, Mizuho and Mitsui Sumitomo. But they require the relationship in Japan. If there is no relationship in Japan, company cannot open corporate bank account. So company do not have relationship, they have to give up setting up a company in Malaysia.
I suggest the other way to save this company. You must try to open corporate bank account in some foreign bank in Malaysia. If you are lucky, you can open. If you need our help, please contact me and I can help you to open corporate bank account.
