今回は前回に引き続き、MM2Hビザによる投資活動についてご紹介致します。
前回記載させて頂きました、
MM2Hビザによる投資活動と就労に関するMIDA（管轄当局）の見解は
以下のものとなります。
MM2H pass holder are allowed to invest in Malaysia. However, to start a business, MM2H participant may own a business but they are not allowed to conduct a business actively in Malaysia. MM2H participants are allowed to invest in a local company and may even sit on the board of directors, but must not be involved in day-to-day management of the company. They can be non-executive or independent director, which means that they do not run the business actively.
If they intend to run business actively and become an executive director, they need to apply for Pass Penggajian via esd.imi.gov.my. If MM2H participant intends to do business actively, he/she would need to terminate the MM2H Pass.
つまり、マレーシア国内においてビジネスを所有できるが、積極的に指導及び牽引していくことは出来ません。しかし、ローカル企業への投資活動及び取締役会への参加は許されており、非常勤役員ないしは独立取締役となることが可能です。ただ、先に述べた通り、投資先のビジネスを運営することは出来ず、日々の業務に関わることは出来ません。
これは「日々の業務執行をしていない」という形式要件のもと、
MM2H当局は法人での就任可能な役職は非常勤役員、ないし社外取締役のみに限定しております。
上記を踏まえると、
MM2Hビザでの企業の所有及び投資活動、また、非常勤役員、独立取締役として投資先の監視・助言は可能ですが、日々の業務への関与、自営行為は不可能という事になります。
MM2Hビザで事業に携わる場合には、
あくまで投資活動の範囲内で行わなければなりません。
