こんにちは。東京コンサルティングファームの藤井です。今回は、他のASEANの国と違い、少しばかりやっかいな居住性判定についてお話をしていきたいと思います。
Hello. This is Daisuke Fujii of Tokyo Consulting Firm. In this blog, I would like to write something about the “Residential”.
マレーシアでは、滞在したい国で常にトップ３に入る魅力の高い国であるため、居住性を判断する要件については、独特の形が取られています。まずは、居住性を判断する４つの基準をお話しします。
Many people would like to want to stay in Malaysia for a long time. So, many people come or visit to Malaysia. In this reason, Malaysia government defines a unique “Residential”. Now, I start writing the 4 standards of “Residential”.
1. 当該年度におけるマレーシアに182日以上滞在した場合
- 当該年度におけるマレーシアの滞在が182日未満であるが、当該年度の直前、もしくは直後の年度において「連続して」かつ「継続して」182日以上マレーシアに滞在した場合
- 当該年度中における滞在日数が90日以上であり、直前4年度中3年度において居住者であるかまたは90日以上滞在する場合
- 当該年度中においてマレーシアには全く滞在しない場合であっても、直前3年間および直後の年度では居住者と認定されている場合
- he is in Malaysia in that basis year for a period or periods amounting in all to one hundred and eighty-two days or more;
- he is in Malaysia in that basis year for a period of less than one hundred and eighty-two days and that period is linked by or to another period of one hundred and eighty-two or more consecutive days throughout which he is in Malaysia in the basis year for the year of assessment immediately preceding that particular year of assessment or in that basis year for the year of assessment immediately following that particular year of assessment:
- he is in Malaysia in that basis year for a period or periods amounting in all to ninety days or more, having been with respect to each of any three of the basis years for the four years of assessment immediately preceding that particular year of assessment either-
- he is resident in Malaysia within the meaning of this Act for the basis year for the year of assessment following that particular year of assessment, having been so resident for each of the basis years for the three years of assessment immediately preceding that particular year of assessment.
ここから、一つずつ見ていきたいと思います。
1.当該年度におけるマレーシアに182日以上滞在した場合

こちらは、非常にシンプルですので、ここでの詳細な説明はいたしません。
This is very simply. I do not explain in detail here.
2.当該年度におけるマレーシアの滞在が182日未満であるが、当該年度の直前、もしくは直後の年度において「連続して」かつ「継続して」182日以上マレーシアに滞在した場合

こちらは、下記の例をご参照ください。
Please refer to it as below.
例） 滞在期間（2014年10月1日〜2015年4月20日）
Example) The term of staying (2014/10/01~ 2015/ 04/20)
3.当該年度中における滞在日数が90日以上であり、直前4年度中3年度において居住者であるかまたは90日以上滞在する場合
Please see the No.3
※ 判定する年度の直前の4年間のうち、2012年度、2014年度は90日以上の滞在、2013年度は、2.の条件に該当し、居住者扱いとなります。このことから、「当該年度中における滞在日数が90日以上であり、直前4年度中3年度において居住者であるかまたは90日以上滞在する場合」に該当することになるため、2015年度（当該年度）も居住者扱いとして扱われます。
※ At 2012, 2014, you stay over 90 days and you are seemed as Residential in 2013 in according with No.2 in 4 years before the years. In this reason, you are seemed as Residential in the years.
- 当該年度中においてマレーシアには全く滞在しない場合であっても、直前3年間および直後の年度では居住者と認定されている場合
4. Please see the No.4.

Example)
2011〜2013と2015年度が居住者として判断されているので、2014年度も居住者として扱わられることとなります。
In 2011~2013 and 2015, you are seemed as Residential, so you are seemed as Residential in 2014.
現地に駐在している方であれば、そこまで判断に迷うところはないのですが、３ヶ月程度滞在している方については、少し注意してみておく必要がございます。
If you stay in Malaysia to work, there is less possibility to check your Residential. However, you stay in Malaysia as traveler or temporarily worker, you should care about your residentiall.
