今回のブログでは「超過時間勤務の算出方法」についてのご質問にお答えします。
Q. 残業代支給の超過時間勤務の算出は、1日単位(8時間超)か週単位(48時間超)のどちらになりますか。
A. 1日単位(8時間超)になります。
【参照、労働法87条】
Art. 87. Overtime work. Work may be performed beyond eight (8) hours a day provided that the employee is paid
for the overtime work, an additional compensation equivalent to his regular wage plus at least twenty-five percent (25%) thereof.
Work performed beyond eight hours on a holiday or rest day shall be paid an additional compensation equivalent
to the rate of the first eight hours on a holiday or rest day plus at least thirty percent (30%) thereof.
8時間を超えて勤務した従業員は、通常の賃金に加えて通常の賃金の25％以上の割増賃金を受ける。
祝日や休息日に8時間を超えて勤務した従業員は、最初の8時間の賃金に加えて30％以上の超過勤務手当を受ける。
