The foreign contractor may be a general contractor, a prime contractor, a partnership contractor or a sub-contractor.<\/p>\n

Pursuant to the clause 28 Article 3 of the Construction license dated 18 June 2014 of the Nation Assembly of Vietnam, \u201cContractor in construction investment activities (below referred to as contractor) means an organization or individual that has full construction capacity or practice capacity when participating in contractual relations in construction investment activities\u201d.<\/p>\n

According to clause 3 Article 57 of Decree 59\/2015\/ND-CP dated 18 June 2015 of the Government, amended by Decree 42\/2017\/ND-CP dated 5 April 2017 and Decree 100\/2018\/ND-CP dated 16 July 2018, \u201cThe organization engaging in the construction activities specified in Clause 1 of this Article must be an enterprise that is prescribed by the Law on Enterprises or an organization that is licensed to carry out construction activities and established as prescribed by law and must meet the requirements applied to each field as prescribed in this Decree\u201d.<\/p>\n
