There are some company that invest with 100% foreign capital to hold cross-shareholdings. In that case, Thai company A hold 51% of another company B, and Japanese company hold remaining 49%. B will be Thai company, since company A, major shareholder of B, is Thai company. Then,  B hold 51% of A, and Japanese company hold remaining 49%. Therefore, both of them are Thai company and invest with 100% foreign capital substantially.<\/p>\n

However,  51% shareholder of A initially should be  other Thai person or Thai company. Also, there are risks that those company is regards as illegal status on FBA.<\/p>\n

\u203bAt this moment, this scheme is on legal, but there are opinions that this scheme is  a kind of chink in the low. Therefore, we recommend you to consult with law firm in advance. And we need over three shareholders for nonpublic company, although I mentioned only two shareholders above. <\/p>\n
