Q Malaysia government issued Minimum Retirement Age Act 2012 at 2013. In this law, minimum age is 60 years old. If employee gets 60 years, Company can employee to retire?<\/p>\n

A In this law, company shall not ask employee to retire under 60 years old. This means that you cannot ask employee to retire at 60 years old. It means you shall decide and put the retirement age in the company handbook. The reason why is that Malaysia is “Common-Law”. Before 2013, Malaysia Supreme Court judged illegal if you do not decide and put retirement age in the handbook. So, if you do not decide and put the retirement age in the handbook, there is a possibility of that Malaysia Supreme Court judge illegal in according with the prior judgment.<\/p>\n
