In this blog, I would like to talk about the general disciplinary action flow.<\/p>\n<p>&nbsp;<\/p>\n<p>\u30de\u30ec\u30fc\u30b7\u30a2\u3067\u306f\u3001\u89e3\u96c7\u304c\u975e\u5e38\u306b\u96e3\u3057\u3044\u74b0\u5883\u3067\u3042\u308a\u3001\u6b63\u5f53\u306a\u624b\u7d9a\u304d\u3092\u8e0f\u3093\u3067\u3044\u304f\u5fc5\u8981\u304c\u3042\u308a\u307e\u3059\u3002\u4ee5\u4e0b\u3067\u4e00\u822c\u7684\u306a\u30d5\u30ed\u30fc\u3067\u306f\u3042\u308a\u307e\u3059\u304c\u3001\u305d\u306e\u6982\u8981\u306b\u3064\u3044\u3066\u793a\u3057\u3066\u3044\u304d\u305f\u3044\u3068\u601d\u3044\u307e\u3059\u3002<\/p>\n<p>In Malaysia, it is too difficult for every company to dismissal their employees. The company shall comply with proper procedures. In this blog, I would like to tell you the general process of dismissal.<\/p>\n<p>&nbsp;<\/p>\n<p>\u2460\u3000\u8b66\u544a\u66f8\u306e\u767a\u884c\uff08Warning Letter\uff09<\/p>\n<p>\u2460&nbsp;&nbsp;&nbsp; Issuing the &ldquo;Warning Letter&rdquo;.<\/p>\n<p>&nbsp;<\/p>\n<p>\u4eba\u4e8b\u90e8\u306a\u3044\u3057\u306f\u7dcf\u52d9\u90e8\u304b\u3089\u3001\u767a\u751f\u3057\u305f\u554f\u984c\u306b\u5bfe\u3057\u3066\u3001\u8b66\u544a\u66f8\u3092\u51fa\u3057\u3001\u5f93\u696d\u54e1\u306b\u5bfe\u3057\u3066\u662f\u6b63\u3092\u4fc3\u3057\u307e\u3059\u3002\u3053\u306e\u66f8\u985e\u306f\u3001\u5f93\u696d\u54e1\u3092\u89e3\u96c7\u3057\u3001\u4e0d\u5f53\u89e3\u96c7\u3068\u3057\u3066\u3001\u4e07\u304c\u4e00\u88c1\u5224\u6240\u3067\u4e89\u3046\u3053\u3068\u306b\u306a\u3063\u305f\u3068\u3057\u3066\u3082\u89e3\u96c7\u3092\u6b63\u5f53\u5316\u3059\u308b\u88cf\u4ed8\u3051\u3068\u306a\u308b\u8a3c\u62e0\u306e\u4e00\u3064\u306b\u306a\u308a\u307e\u3059\u3002<\/p>\n<p>Administration or HR department shall issue &ldquo;Warning Letter&rdquo; to employee who fails to follow the company regulation to improve their act. In event that you are sued by the employee who say the illegal dismissal,&nbsp; this letter is a one of the certification of dismissal. Please keep the original in the Company.<\/p>\n<p>&nbsp;<\/p>\n<p>\u2461&nbsp;&nbsp;&nbsp; \u7406\u7531\u5448\u793a\u547d\u4ee4\u66f8\u306e\u767a\u884c<\/p>\n<p>\u2461&nbsp; Issuing the &ldquo;Statement of Reasons&rdquo;.<\/p>\n<p>&nbsp;<\/p>\n<p>\u3053\u306e\u66f8\u985e\u306f\u4e2d\u3005\u805e\u304d\u899a\u3048\u304c\u306a\u3044\u304b\u3068\u306f\u601d\u308f\u308c\u307e\u3059\u304c\u3001\u8b66\u544a\u66f8\u3092\u767a\u884c\u3057\u305f\u5f8c\u3082\u3001\u5f53\u5f93\u696d\u54e1\u304c\u554f\u984c\u884c\u52d5\u3092\u662f\u6b63\u3057\u306a\u3044\u5834\u5408\u3001\u305d\u306e\u884c\u52d5\u3092\u8d77\u3053\u3057\u305f\u7406\u7531\u3092\u5f93\u696d\u54e1\u304b\u3089\u6c42\u3081\u308b\u66f8\u985e\u3068\u306a\u308a\u307e\u3059\u3002\u3053\u308c\u306b\u5bfe\u3057\u3066\u3001\u5f93\u696d\u54e1\u306f\u6700\u5927\u3067\uff13\u65e5\u4ee5\u5185\u306b\u305d\u306e\u7406\u7531\u3068\u7406\u7531\u306e\u6b63\u5f53\u5316\u3059\u308b\u3082\u306e\u3092\u8a18\u8f09\u3057\u3066\u8fd4\u7b54\u3057\u306a\u3051\u308c\u3070\u306a\u308a\u307e\u305b\u3093\u3002\u3053\u306e\u5834\u5408\u4e2d\u3057\u306a\u3051\u308c\u3070\u3044\u3051\u306a\u3044\u306e\u304c\u3001\u8b66\u544a\u66f8\u9001\u4ed8\u5f8c\u3059\u3050\u306b\u767a\u884c\u3068\u8a00\u3046\u308f\u3051\u306b\u306f\u3044\u304b\u305a\u3001\u591a\u304f\u306e\u5834\u5408\u306f\uff12&#12316;\uff13\u56de\u8b66\u544a\u66f8\u3092\u767a\u884c\u3057\u3066\u3082\u662f\u6b63\u3055\u308c\u306a\u3044\u5834\u5408\u306b\u3001\u3053\u306e\u624b\u7d9a\u304d\u306b\u5165\u308b\u306e\u304c\u4e00\u822c\u7684\u3067\u3059\u3002<\/p>\n<p>This document shall be issued after issued &ldquo;Warning Letter&rdquo;. If employee do not follow the Warning Letter issued by the Company again and again (Twice or third time is general), Company have a right to issue this letter. Employee shall response to this letter in 3 days (Maximum) and shall write their reason no to follow the Warning Letter.<\/p>\n<p>&nbsp;<\/p>\n<p>\u2462&nbsp;&nbsp;&nbsp; \u5185\u90e8\u76e3\u67fb\u624b\u7d9a\u304d<\/p>\n<p>\u2462 Internal Audit<\/p>\n<p>&nbsp;<\/p>\n<p>\u30de\u30ec\u30fc\u30b7\u30a2\u306e\u89e3\u96c7\u306e\u96e3\u3057\u3055\u306e\u8981\u56e0\u306e\u4e00\u3064\u3067\u3082\u3042\u308b\u5185\u90e8\u76e3\u67fb\u3002\u3053\u308c\u306f\u3001\u4ee5\u524d\u306b\u672c\u30d6\u30ed\u30b0\u3067\u3055\u308f\u308a\u7a0b\u5ea6\u306f\u304a\u4f1d\u3048\u3055\u305b\u3066\u3044\u305f\u3060\u304d\u307e\u3057\u305f\u304c\u3001\u4e3b\u306b\u306f\u7b2c\u4e09\u8005\u306e\u7acb\u3061\u4f4d\u7f6e\u306b\u3042\u308b\u65b9\u3092\u4efb\u547d\u3057\u3001\u9032\u3081\u3066\u3044\u304d\u307e\u3059\u3002\u3053\u306e\u5185\u90e8\u76e3\u67fb\u624b\u7d9a\u304d\u3068\u3044\u3046\u306e\u306f\u3001\u67fb\u554f\u4f1a\u3068\u547c\u3070\u308c\u308b\u3082\u306e\u3067\u3042\u308b\u3002\u4e3b\u306a\u30e1\u30f3\u30d0\u30fc\u69cb\u6210\u306f\u4ee5\u4e0b\u306e\u901a\u308a\u3067\u3059\u3002\u8b70\u9577\u3001\u691c\u5bdf\u5b98\u3001\u79d8\u66f8\u3001\u51fa\u5e2d\u8005\u3001\u61f2\u6212\u5bfe\u8c61\u5f93\u696d\u54e1\u3002\u3053\u3053\u3067\u3001\u5f93\u696d\u54e1\u304b\u3089\u306e\u5f01\u660e\u3092\u805e\u304d\u3001\u4eca\u307e\u3067\u306e\u8b66\u544a\u66f8\u306a\u3069\u3092\u3082\u3068\u306b\u3001\u89e3\u96c7\u3092\u3059\u308b\u306e\u304b\u3057\u306a\u3044\u306e\u304b\u306e\u5224\u65ad\u3092\u4e0b\u3057\u307e\u3059\u3002<\/p>\n<p>Internal Audit is one of characteristic of Malaysia labor law. The Company shall make the committee. This committee shall be consisted of the Third person (Who is not relevant in this matter). The member of this committee is Chairman, Prosecutor, Secretary, Attendance and Employee (who do not follow the Warning Latter). This committee can decide to dismissal Employee or not.<\/p>\n<p>&nbsp;<\/p>\n<p>\u2463\u3000\u89e3\u96c7<\/p>\n<p>\u2463&nbsp; Dismissal<\/p>\n<p>&nbsp;<\/p>\n<p>\u5185\u90e8\u76e3\u67fb\u624b\u7d9a\u304d\u3067\u3001\u89e3\u96c7\u3059\u308b\u306b\u6b63\u5f53\u306a\u7406\u7531\u304c\u3042\u308b\u3068\u8a8d\u3081\u3089\u308c\u305f\u5834\u5408\u3001\u4f01\u696d\u306f\u3053\u3053\u3067\u89e3\u96c7\u306b\u8e0f\u307f\u5207\u308c\u307e\u3059\u3002<\/p>\n<p>In the process of Internal Audit, if there is some certification of the reason to dismissal, the Company is able to dismissal Employee.<\/p>\n<p>&nbsp;<\/p>\n<p>\u3053\u3053\u307e\u3067\u306e\u624b\u9806\u3092\u3057\u3063\u304b\u308a\u3068\u8e0f\u307f\u3001\u89e3\u96c7\u3092\u3057\u305f\u5834\u5408\u3001\u4e07\u304c\u4e00\u88c1\u5224\u6240\u3067\u4e0d\u5f53\u89e3\u96c7\u3067\u3042\u308b\u3068\u8a34\u3048\u3089\u308c\u305f\u3068\u3057\u3066\u3082\u3001\u8ca0\u3051\u308b\u78ba\u7387\u306f\u3050\u3063\u3068\u4f4e\u304f\u306a\u308a\u307e\u3059\u3002<\/p>\n<p>&nbsp;<\/p>\n<p>There is a less possibility to be sued Company by Employee after the dismissal if Company make proper step.<\/p>\n<p>&nbsp;<\/p>\n<p>\u3053\u3053\u3067\u306f\u5927\u304d\u304f\u3001\u624b\u7d9a\u304d\u89e3\u96c7\u306e\u6982\u8981\u306b\u3064\u3044\u3066\u304a\u8a71\u3092\u3057\u307e\u3057\u305f\u3002\u500b\u5225\u3067\u3001\u8a73\u3057\u3044\u3053\u3068\u3092\u304a\u805e\u304d\u306b\u306a\u308a\u305f\u3044\u5834\u5408\u3001\u79c1\u304b\u304a\u554f\u3044\u5408\u308f\u305b\u30d5\u30a9\u30fc\u30e0\u304b\u3089\u304a\u554f\u3044\u5408\u308f\u305b\u9802\u3051\u308c\u3070\u5e78\u3044\u3067\u3059\u3002<\/p>\n<p>&nbsp;<\/p>\n<p>I just introduced you the general procedures of dismissal in this blog.
